Terms of Service

Gangsta Geeks LLC dba TrukRun · Dickinson, Texas · Effective September 19, 2026 · See also Privacy Policy

These terms are the agreement between you and Gangsta Geeks LLC, doing business as TrukRun, of Dickinson, Texas, for the TrukRun website, ordering pages, dashboard and text messages. By creating an account, placing an order or ticking a consent box, you agree to them. Our Privacy Policy explains what we do with your information and is part of these terms.

1What TrukRun is

TrukRun is software. A food truck operator uses it to publish a menu, take orders, run a kitchen screen, text customers and, optionally, accept card payments. Customers use a truck’s page to order. The food is sold by the truck, not by TrukRun. Each operator is responsible for its menu, prices, food safety, licences, taxes, order fulfilment and refunds. TrukRun provides the tools and the payment plumbing.

2Accounts

  • You must be 18 or older and able to enter a contract to open an operator account. You can sign up with an email and password or with Google.
  • You are responsible for everything done under your account. Keep your password private and tell us at once if you think it has been used without permission.
  • One account runs one truck. Give us accurate details and keep them current; customers rely on the address, hours and phone number you publish.
  • We may suspend or close an account that breaks these terms, is used for fraud, or stays unused for a long time after notice.

3Plans, fees and billing

  • No monthly subscription on Starter. The Starter plan has no monthly subscription or time limit. Card-order and payment-processing fees still apply as shown on the pricing page. Paid plans (Kitchen, Growth, Autopilot and the legacy Autopilot+) add features listed on the pricing page.
  • Monthly billing. Paid plans bill monthly in advance through Stripe. Prices are in US dollars and exclude any sales tax we are required to collect.
  • Changes and cancellation. You can change or cancel your plan any time from Dashboard → Billing. Moving between paid plans is prorated. Cancelling keeps your plan until the end of the period you paid for; no partial-month refunds.
  • Failed payments. If a renewal fails you keep your plan for a 7-day grace period while Stripe retries. After that the truck returns to Free. Your storefront and QR keep working; paid tools pause until payment clears.
  • TrukRun fee on card orders. When a customer pays by card through your page, TrukRun keeps a percentage of the food subtotal (after promos, before tax and tip) as an application fee. The percentage depends on your plan and is shown on the pricing page and in your dashboard. Pay-at-window orders carry no TrukRun fee. Stripe’s processing fees are separate and are charged by Stripe under its own terms.
  • Price changes. We give at least 30 days’ notice by email before a plan price or fee percentage rises.

4Card payments and payouts (operators)

Card payments run on Stripe Connect. To accept them you open a Stripe Express account through your dashboard and agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. Charges are made directly on your Stripe account; Stripe pays you out on its schedule; TrukRun collects its fee from each charge. You are the merchant of record for every sale. You handle customer disputes and chargebacks, and you refund orders you cannot fulfil. On a full refund TrukRun returns its fee; on a partial refund the fee stays.

5Ordering (customers)

  • Placing an order is an offer to buy from the truck. The truck accepts it by starting to cook. Prices, tax and tip are shown before you confirm.
  • Pay at the window or by card on your phone. Card payments are taken by the truck through Stripe; your receipt comes from Stripe.
  • Pickup times are estimates. Trucks may pause ordering, cap open orders or add a prep delay when they are slammed; the page tells you before you order.
  • Cancellations and refunds are between you and the truck. Contact the truck first using the number on its page; email adam@smartscale25.com if you cannot reach them.
  • Event pre-orders. Some trucks take pre-orders for an event with a target number of orders. Your card is authorised when you order and charged only if the event fills by its cutoff. If it does not, the hold is released and nothing is charged. If the truck cancels a filled event, everyone is refunded in full.
  • Promo codes are set by the truck and may be limited, withdrawn or changed at any time.

6Text messages

By ticking the consent box at checkout or on a truck’s “text me when they open” form, you agree to receive automated service texts from TrukRun on behalf of that truck at the mobile number you gave: order accepted, order ready, running late, a one-time request to rate your order, and go-live alerts for trucks you subscribed to. Consent is not a condition of purchase; you can always order without it. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help. Operators agree to use customer texting only for these service messages and never for unsolicited marketing.

7Your content

Operators keep ownership of the menus, photos, names and descriptions they upload. You give TrukRun a licence to store, process and display that content to run the service, including sending menu photos to an AI model for import and showing your storefront to customers. You confirm you have the right to use everything you upload and that it is accurate, lawful and not misleading. We may remove content that breaks these terms or the law.

8AI features

Menu import, phone answering and marketing tools on the Autopilot plans use AI models. They are helpful but not perfect. You review imported items and prices before publishing, and you are responsible for what your storefront says and what your AI receptionist promises a caller. Do not rely on AI output for allergen or dietary claims without checking it.

9Acceptable use

Do not use TrukRun to break the law, to sell anything you are not licensed to sell, to send texts to people who did not consent, to place fake or abusive orders, to scrape or overload the service, to reverse engineer it, or to impersonate another truck or person. We may rate-limit, suspend or terminate accounts that do.

10Third-party services

TrukRun relies on Stripe, Google, Supabase, Vercel, messaging carriers and other providers. Their availability and terms are outside our control. Links to third-party sites are for convenience; we are not responsible for their content.

11Availability and changes

We work to keep TrukRun up during service hours, but we do not promise uninterrupted or error-free operation. We may change, add or retire features. If a change materially reduces what a paid plan does, we tell operators at least 30 days ahead, and you may cancel for a prorated refund of the current month.

12Disclaimer of warranties

TrukRun is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will meet your requirements or that orders, texts or payments will always be delivered without delay.

13Limitation of liability

To the fullest extent the law allows, Gangsta Geeks LLC and its owners, staff and providers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from the service. Our total liability for any claim is limited to the greater of (a) the plan fees and TrukRun fees you paid us in the 12 months before the claim, or (b) $100. Some jurisdictions do not allow these limits; where they apply, our liability is limited to the smallest amount the law permits.

14Indemnity

Operators agree to defend and indemnify Gangsta Geeks LLC against claims, losses and costs (including reasonable legal fees) arising from the food they sell, their content, their use of customer texting, their taxes and licences, or their breach of these terms.

15Termination

You can close your account at any time from the dashboard or by emailing us. We can suspend or close accounts as described above. On closure your storefront goes offline; we keep order and payment records for the period the Privacy Policy states and delete the rest. Sections 12 to 17 survive termination.

16Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute that we cannot settle by talking will be brought in the state or federal courts in Galveston County, Texas, and you consent to their jurisdiction. Either party may seek an injunction in any court to protect its intellectual property. Nothing here limits consumer rights that cannot be waived under the law of your home state.

17General

These terms, the Privacy Policy and the pricing page are the entire agreement between us about TrukRun. If any part is unenforceable, the rest still applies. Our not enforcing a term is not a waiver. You may not assign these terms without our consent; we may assign them to a successor of the business. When we change these terms we update the effective date above and, for material changes, email operators 30 days ahead. Continuing to use TrukRun after that date means you accept the new terms.
